Terms and Conditions
These clauses will provide you with the information that you need to know about our working method, and will serve as a guide in resolving doubts and/or conflicts that may arise.

Agreement between client and Tatch Taboada
This document is an agreement between you as a client and Tatch Taboada as your video design service provider. publishing and other services described on this Website. By contracting the services of Tatch Taboada you must have read and accepted the terms and conditions drawn up in this agreement, since it lists the rights and obligations for both parties.

1. Quotation and work proposal
Our prices are subject to change without notice. In the event that the client has not contracted the project and the prices have been modified, a new quote will be made with the new prices.

(1a.) Pay VAT
Our quotes are valid for 15 business days and include VAT payment if an invoice is required

(2b.) Balance in favor
In case of having a favorable balance, this balance must be used in hours. Discounts will not apply.

2. Project development
Advance
Before starting work on any project, a down payment is required for our services.

If they are projects with costs less than 1,500 USD, a 50% advance is required, 30% after the design stage, and the rest upon delivery. If the project has a cost greater than 1,500 USD, an advance of 40% is required and the rest against delivery.

work process

Development is divided into five stages:

1. Reception of material: The client sends the necessary material to start the project, in the case of the logo or name, the material is the questionnaire for logos or name, the information for the creation of the project

2. Design stage: Creation of graphic or video material will be sent in image or low resolution previews. If the client requires a full render for visualization, an extra cost is generated. for this service

3. Feedback The project is sent to the client and their comments are obtained

4. Debugging stage of the project, the changes or adjustments indicated by the client are made, during this stage the client can request the rounds that were explicit in the change/modification quote. (3 changes) Additional revisions will have an additional cost.

5 Submission of final materials and assets for distribution

Tatch Taboada will present the design proposal (moodboard) to the client for approval and/or modification. Upon approval by the client, work will begin on the development of the project. Any additional modification requested on the previously approved design will generate an extra charge. The client will be kept informed.

At the end of the development of the project, the short version will be shown to the client, who must carry out a final review of the video to make sure that all the perceptions are correct, and may also request the modifications mentioned in the quote to adjust the last details.

Any annexation of additional information to the video or modifications to the previously approved formats will be quoted separately. Sometimes it will be necessary to finalize the remaining 50% of the project before carrying out the new modifications. Tatch Taboada undertakes to keep the client informed and to determine the best time to carry out said modifications, taking into account the working hours and the difficulty of the same.

3. Final payment and delivery of the project

When the project is finished, the client will be asked for the final payment of 50%, which must be covered no later than the following 5 business days. If the client takes more than the stipulated time to complete the project, a penalty of 2% of the final payment per day of delay will be charged. Tatch Taboada is exempt from delivering the project to the client as long as the entire payment has not been covered.

(3a.) Warranty
The delivery stage has a guarantee of only 30 days and applies only for technical errors and not for changes.

(3b.) Editable files
Editable files will not be delivered to the client. The files are the only ones that are not delivered without having an agreement at the beginning of the project.

4. Extra Charges

In order not to affect the client's budget, any extra charge that may be generated during the project, WILL ALWAYS BE NOTIFIED TO THE CLIENT BEFORE CARRYING IT OUT. The client will decide to give his approval to go ahead with the modifications, or discard them and continue with what was previously quoted. The extra charges can be calculated by working hours taking into account the degree of difficulty of the modifications, or by object according to our price list.

5. Cancellation of the project and returns

Any cancellation of the service by the client is exempt from the return of any amount of money by Tatch Taboada.

Tatch Taboada is free to cancel or terminate the project in the event that the client, during the development of the project, does not comply with its obligations in this agreement.

The following are cases of project cancellation:
Abandoned project: After 20 business days of receiving the first deposit, the project will be cancelled. If the client wishes to resume the project, it will be completely re-quoted.

Lack of material (content, photos, key information): If the client does not deliver the necessary material to carry out the project after 20 business days, the project will be canceled or requoted.

Project on hold: If for any reason on the part of the client the project has to be put on hold, the quote will have to be reviewed and a new agreement reached.

Lack of response from the client: If within 20 business days the project is paused due to lack of response or interest from the client, it will be considered an abandoned project.

6. Promotions

Promotions will be modified or replaced after some time. In the event that the promotion or discount is no longer on the page, tatch taboada is not obliged to make said promotion valid.

Some promotions are exclusive for existing customers of tatch taboada to reward their loyalty and preference, and for this reason they cannot be applied to a new customer, under any circumstances.

 

7. Modifications to this agreement
The current terms and conditions are subject to change without prior notice from tatch taboada.

8. Subcontracting
tatch taboada has the right to sub-contract to ensure that projects are carried out properly without prior notice to the client.

9. Pro-product terms:
CMS: Purchasing this product is a one-year commitment.

​

10. Prohibited material:

Tatch Taboada has the right to reject the following:

1. Any means of communication that is illegal or inappropriate;

2. Any media that contains a virus or hostile program;

3. Any means of communication that constitutes harassment, racism, violence, obscenity, spam or intent to harm;

4. Any means of communication that constitutes a criminal offense, violates privacy or copyright;

5. Any other questionable means will be under the discretion of tatch taboada
